Terms of Service

The AI Sommelier (the “Service”) is an AI-powered cellar, pairing, and event-planning companion operated by Wine Hound LLC (“Wine Hound,” “we,” “us”), a limited liability company organized in the State of Kansas, United States. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Legal drinking age

You must be of legal drinking age where you live (21 or older in the United States) to use the Service. By creating an account you confirm that you meet this requirement. Where a winery, distributor, or other partner provisions an account for one of its members, that partner confirms the member’s age on your behalf under its own agreement with us.

2. Your account

You agree to provide accurate information, to keep your login secure, and to be responsible for activity under your account. Accounts are for one person; do not create multiple accounts to get around usage limits. We may suspend or close an account that violates these Terms or that we reasonably believe is being used to abuse the Service.

3. Fair use and limits

The Service is offered without charge on our free tier. To keep it available and affordable for everyone, use is subject to limits, including per-minute rate limits and daily usage quotas, which we may adjust at any time. Automated access (bots, scrapers, scripts, or bulk requests) is not allowed, and neither is attempting to bypass rate limits, quotas, verification steps, or other technical protections. We may throttle, pause, or suspend access that we reasonably believe is automated, excessive, or degrades the Service for others.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • attempt to extract, reverse-engineer, or misuse the underlying AI systems, including through prompt-injection or similar attacks;
  • resell, redistribute, or provide third-party access to the Service or its outputs at scale; or
  • interfere with or attempt to compromise the operation or security of the Service.

5. AI guidance, not advice

Recommendations, pairings, drink-window estimates, and event plans are generated by an AI system and are provided for informational and entertainment purposes only. They are honest best-efforts from wine knowledge, and bottles, like dogs, have minds of their own: they may be inaccurate or incomplete, and we make no guarantee about the suitability, availability, price, or quality of any wine or pairing suggested. Nothing in the Service is medical, dietary, financial, or other professional advice. Please enjoy wine responsibly.

6. Buying wine

We recommend; we do not sell. Any purchase happens directly with the winery, shop, or distributor you buy from, under their terms and their responsibility for age verification, payment, shipping, and compliance.

7. White-label deployments

Where the Service is deployed for a winery or distributor partner under their own branding, that partner operates it under their own terms and privacy notice in addition to these Terms. Those partner terms govern your relationship with the partner; these Terms govern the underlying Service provided by Wine Hound LLC.

8. Availability and changes

The Service is provided “as is” and “as available.” We may modify, limit, suspend, or discontinue the Service or any feature (including free access) at any time. Capacity limits may make the Service temporarily unavailable; when that happens your saved cellar, events, and plans remain intact.

9. Your content and our rights

You keep the rights to the information you submit, such as your cellar and your messages to the sommelier. You grant us a license to process that information to operate and improve the Service. The Service itself, including its design, branding, and software, belongs to Wine Hound LLC. See our Privacy Policy for how we handle your data.

10. Termination

You may stop using the Service at any time. We may suspend or end your access for a violation of these Terms, for suspected abuse, or if we discontinue the Service.

11. Warranties and limitation of liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Wine Hound LLC and its owners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, and our total liability for any claim relating to the Service will not exceed one hundred United States dollars (US $100) or the amount you paid us for the Service in the twelve months before the claim, whichever is greater.

12. Changes to these Terms

We may update these Terms. Each version is dated and numbered, and your account records the version you accepted. If we make a material change, we will ask you to review and accept the new version before you continue using the Service.

13. Governing law

These Terms are governed by the laws of the State of Kansas and the applicable laws of the United States, without regard to conflict-of-law rules. The state and federal courts located in Kansas will have exclusive jurisdiction over any dispute that is not resolved informally.
